Introduction

These terms and conditions govern your use of this website; by using this website, you accept these terms and conditions in full. If you disagree with these terms and conditions or any part of these terms and conditions, you must not use this website.

This website uses cookies. Strictly necessary cookies are set automatically to ensure the website functions correctly. For all other cookies, your separate and explicit consent is required in accordance with inlingua International Ltd.’s Privacy Policy and Cookies Policy, available at www.inlingua.com/privacy-policy and www.inlingua.com/cookie-policy.

Definitions

  • “inlingua” means inlingua International Ltd., Belpstrasse 11, CH-3007 Bern, Switzerland.
  • “User” means any person who accesses or uses the Website or Services.
  • “Website” means www.inlingua.com and all related subdomains.
  • “Services” means the online learning platform (my.inlingua.com), website content, and all related tools and features provided by inlingua.

Scope

These Terms apply to all users of the Website and Services, including visitors, licensees, and business partners, except where local Center terms explicitly override them.

License to Use Website

Unless otherwise stated, inlingua International Ltd. and/or its licensors own the intellectual property rights in the website and material on the website. Subject to the license below, all these intellectual property rights are reserved.

You may view, download for caching purposes only, and print pages or other content from the website for your own personal use, subject to the restrictions set out below and elsewhere in these terms and conditions. You must not:

  • republish material from this website (including republication on another website);
  • sell, rent or sub-license material from the website;
  • show any material from the website in public;
  • reproduce, duplicate, copy or otherwise exploit material on this website for a commercial purpose;
  • edit or otherwise modify any material on the website; or
  • redistribute material from this website except for content specifically and expressly made available for redistribution.

Intellectual Property – Learning Materials

inlingua is the sole owner of all inlingua teaching materials and platform content. The User does not acquire any right, title, interest, or claim of ownership in such materials by using the Services. The User agrees not to record, reproduce, or publish any online learning session or teaching material without inlingua’s prior written consent. This clause applies in addition to the License to Use Website section above.

Age Restrictions

Users under the age of 16 may not use the Services without verifiable parental or legal guardian consent, in accordance with GDPR Article 8 and revFADP. Users aged 16 to 17 must obtain parental or legal guardian consent before using the Services. inlingua does not knowingly collect personal information from children without such consent. Where parental consent is required, the local inlingua Center will provide the applicable consent procedure.

Acceptable Use

You must not use this website in any way that causes, or may cause, damage to the website or impairment of the availability or accessibility of the website; or in any way which is unlawful, illegal, fraudulent or harmful, or in connection with any unlawful, illegal, fraudulent or harmful purpose or activity.

You must not use this website to copy, store, host, transmit, send, use, publish or distribute any material which consists of (or is linked to) any spyware, computer virus, Trojan horse, worm, keystroke logger, rootkit or other malicious computer software.

You must not conduct any systematic or automated data collection activities (including without limitation scraping, data mining, data extraction and data harvesting) on or in relation to this website without inlingua International Ltd.’s express written consent. You must not use this website to transmit or send unsolicited commercial communications. You must not use this website for any purposes related to marketing without inlingua International Ltd.’s express written consent.

Conduct and Abusive Behaviour

Users are expected to engage respectfully with all participants of inlingua’s online services, including trainers and fellow learners. If a User shows disrespect or demonstrates aggression towards any participant, inlingua reserves the right to immediately suspend or terminate access to the services without refund. This applies in conjunction with the Acceptable Use provisions above.

Account Conditions

To access the learning services, the User must register and book following the instructions of the Center or as described on the inlingua website. Each User will be assigned a personal login and password. The rights of access to and use of the services are strictly personal and non-transferable. The User is responsible for maintaining the confidentiality of their login credentials and must not share them with any third party.

When registering, the User agrees to provide true, accurate, up-to-date, and complete personal information and to keep this information current. The User agrees not to create a false identity.

The User may correct or update their account information at any time via the account settings page. Account deletion requests must be submitted to inlingua Customer Support or the local Center. Upon deletion, no refunds are due for unconsumed services and no user data can be retrieved thereafter, except where mandatory statutory rights apply under applicable law. inlingua will retain account information for as long as the account is active or as required to fulfil legal obligations, resolve disputes, and enforce agreements. An account remains active even after a paid subscription has expired.

Content of Services

The educational services provided by inlingua are described on the website www.inlingua.com/learn-languages. inlingua reserves the right to modify, suspend, or discontinue any service or content at any time without prior notice, except where required by applicable law.

Access to Services

Use of the inlingua online learning services takes place exclusively online. The User has a free choice of location for learning. The local inlingua Center can combine the online offer with additional local services.

inlingua and its providers may need to interrupt the services or part of the services for maintenance work; the User accepts such temporary interruptions without compensation. Data processed during service interruptions remains protected under our Privacy Policy. inlingua cannot be held responsible for difficulties in accessing the services if the User does not have the minimum technical requirements described on the inlingua website.

Third-Party Tools and Services

inlingua uses third-party tools and services (including but not limited to Microsoft 365, Google Analytics, and the Amelia booking plugin) to provide the Services. Your use of these tools is subject to their respective terms and privacy policies. inlingua acts as the data controller for personal data processed through these tools, and the third-party providers act as data processors under Data Processing Agreements compliant with GDPR Article 28.

Local inlingua Centers and their B2B clients may connect to my.inlingua.com via API or LTI integration. Such integrations are governed by a separate data processing agreement between inlingua and the respective Center. Personal data processed through these integrations remains subject to inlingua’s Privacy Policy.

Your data may be shared with local inlingua Centers, trainers, third-party processors, and—where required by law—with competent authorities, as further described in our Privacy Policy at www.inlingua.com/privacy-policy.

Local Center Terms

Local inlingua Centers may operate under their own terms and conditions. inlingua International Ltd. does not review or control local Center terms. Where local Center terms apply, they operate alongside these Terms. These Terms govern the use of the international Website and Services operated directly by inlingua International Ltd.

No Warranties

This website is provided “as is” without any representations or warranties, express or implied. inlingua International Ltd. makes no representations or warranties in relation to this website or the information and materials provided on this website. Without prejudice to the generality of the foregoing paragraph, inlingua International Ltd. does not warrant that:

  • this website will be constantly available, or available at all; or
  • the information on this website is complete, true, accurate or non-misleading.

Nothing on this website constitutes, or is meant to constitute, advice of any kind.

Limitations of Liability

inlingua International Ltd. will not be liable to you (whether under the law of contract, the law of torts or otherwise) in relation to the contents of, or use of, or otherwise in connection with, this website:

  • to the extent that the website is provided free-of-charge, for any direct loss;
  • for any indirect, special or consequential loss; or
  • for any business losses, loss of revenue, income, profits or anticipated savings, loss of contracts or business relationships, loss of reputation or goodwill, or loss or corruption of information or data.

Exceptions

Nothing in this website disclaimer will exclude or limit any warranty implied by law that it would be unlawful to exclude or limit; and nothing in this website disclaimer will exclude or limit inlingua International Ltd.’s liability in respect of any:

  • death or personal injury caused by inlingua International Ltd.’s negligence;
  • fraud or fraudulent misrepresentation on the part of inlingua International Ltd.; or
  • matter which it would be illegal or unlawful for inlingua International Ltd. to exclude or limit, or to attempt or purport to exclude or limit, its liability.

Reasonableness

By using this website, you agree that the exclusions and limitations of liability set out in this website disclaimer are reasonable. If you do not think they are reasonable, you must not use this website.

Other Parties

You accept that inlingua International Ltd. has an interest in limiting the personal liability of its officers and employees. You agree that you will not bring any claim personally against inlingua International Ltd.’s officers or employees in respect of any losses you suffer in connection with the website. Without prejudice to the foregoing paragraph, you agree that the limitations of warranties and liability set out in this website disclaimer will protect inlingua International Ltd.’s officers, employees, agents, subsidiaries, successors, assigns and sub-contractors as well as inlingua International Ltd.

Indemnity

You hereby indemnify inlingua International Ltd. and undertake to keep inlingua International Ltd. indemnified against any losses, damages, costs, liabilities and expenses (including without limitation legal expenses and any amounts paid by inlingua International Ltd. to a third party in settlement of a claim or dispute on the advice of inlingua International Ltd.’s legal advisers) incurred or suffered by inlingua International Ltd. arising out of any breach by you of any provision of these terms and conditions, or arising out of any claim that you have breached any provision of these terms and conditions.

Breaches of These Terms and Conditions

Without prejudice to inlingua International Ltd.’s other rights under these terms and conditions, if you breach these terms and conditions in any way, inlingua International Ltd. may take such action as inlingua International Ltd. deems appropriate to deal with the breach, including suspending your access to the website, prohibiting you from accessing the website, blocking computers using your IP address from accessing the website, contacting your internet service provider to request that they block your access to the website and/or bringing court proceedings against you.

Variation

inlingua International Ltd. may revise these terms and conditions from time to time. Revised terms and conditions will apply to the use of this website from the date of publication. For material changes, we will provide at least 30 days’ notice via a prominent notice on the Website before such changes take effect. Please check this page regularly to ensure you are familiar with the current version.

Assignment

inlingua International Ltd. may transfer, sub-contract or otherwise deal with its rights and/or obligations under these terms and conditions to a successor entity within the same corporate group without prior individual notice. Any such transfer will be posted on the Website. The terms applicable to your use of the Website and Services will remain unchanged. You may not transfer, sub-contract or otherwise deal with your rights and/or obligations under these terms and conditions.

Severability

If any provision of these terms and conditions is determined by any court or other competent authority to be unlawful and/or unenforceable, the other provisions will continue in effect. If any unlawful and/or unenforceable provision would be lawful or enforceable if part of it were deleted, that part will be deemed to be deleted, and the rest of the provision will continue in effect. You and inlingua International Ltd. agree to replace any invalid term with regulations that conform best to the purpose of the invalid term.

Entire Agreement

These terms and conditions, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and inlingua International Ltd. in relation to your use of this website, and supersede all previous agreements in respect of your use of this website.

Data Protection

For all matters related to the processing of personal data, the provisions of our Privacy Policy shall take precedence over these Terms in case of any conflict. Our Privacy Policy is available at www.inlingua.com/privacy-policy.

If inlingua is required to appoint a Data Protection Officer (DPO) under GDPR Article 37, contact details will be published in the Privacy Policy and updated accordingly.

International Data Transfers

Your personal data may be transferred to and processed in countries outside of Switzerland and the EEA, including the United States. For transfers to third countries, inlingua relies on Standard Contractual Clauses (SCCs) approved by the European Commission or other adequate safeguards as permitted under applicable law. Copies of the relevant safeguards are available upon request at dpo@inlingua.com.

Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with Swiss law. For Users located in the European Economic Area (EEA) or the United Kingdom (under UK GDPR), the General Data Protection Regulation (Regulation (EU) 2016/679) and UK GDPR respectively also apply to the processing of personal data. For Swiss users, data is processed in accordance with the Swiss Federal Act on Data Protection (revFADP).

All disputes relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Berne, Switzerland. Users in the EEA or UK also have the right to lodge a complaint with their local data protection supervisory authority under GDPR Article 77.

EU/EEA User Rights

Users located in the European Economic Area (EEA) or the United Kingdom (under UK GDPR) have the following rights:

  • Right to Access (Article 15): Request a copy of your personal data.
  • Right to Rectification (Article 16): Correct inaccurate or incomplete data.
  • Right to Erasure (Article 17): Request deletion of your data under certain conditions.
  • Right to Restrict Processing (Article 18): Limit how we process your data.
  • Right to Data Portability (Article 20): Receive your data in a structured, machine-readable format.
  • Right to Object (Article 21): Object to processing based on legitimate interests or, where your data is processed for direct marketing purposes, withdraw from such processing at any time without restriction.
  • Right to Withdraw Consent (Article 7(3)): Withdraw consent at any time for processing based on consent.
